These Terms and Conditions (“Terms”) govern access to and use of the PIARC Road Academy website, online learning platform, webinars, assessments, certification activities, and related services available through roadacademy.piarc.org and delivered via LearnWorlds.
By registering for or using the platform and services, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the platform or services.
For the purposes of these Terms:
- "Account" means the personal account created to access the learning platform and services.
- "Content" means all materials made available through the platform, including webinars, videos, presentations, documents, subtitles, assessments, and recordings.
- "Participant" means any individual registered for a webinar, session, or programme.
- "Programme" means the PIARC Road Academy learning programme and related educational activities.
- "Services" means all online services, educational content, webinars, assessments, certification activities, and support services provided by PIARC.
- "Platform" means the online learning environment hosted through LearnWorlds.
- "PIARC", "we", "our", or "us" means the World Road Association (PIARC).
- "User" means any person accessing the website or platform.
The Services are intended for professional and educational use.
Users under the age of 18 may only access the Services under the supervision and responsibility of a parent, guardian, employer, or educational institution.
By registering, you confirm that:

the information provided is accurate and complete;

you are authorised to make the registration and payment;

you will maintain the confidentiality of your login credentials.
Access to certain Services requires the creation of an Account.
You are responsible for:

maintaining the confidentiality of your credentials;

all activity carried out under your Account;

updating your information when necessary.
PIARC reserves the right to suspend or terminate Accounts in cases of misuse, fraudulent activity, breach of these Terms, or conduct incompatible with the professional nature of the Programme.
Programs consists of live online sessions, learning materials, discussions, assessments, and certification activities.
PIARC reserves the right to:

modify session schedules, speakers, or content where reasonably necessary;

substitute equivalent content or delivery methods;
-
postpone or cancel sessions in exceptional circumstances.
All session times are communicated in UTC. Participants are responsible for verifying local time conversions.
Participants agree to behave respectfully and professionally during all live sessions, discussions, forums, and communications.
Users must not:

engage in harassment, discrimination, abusive conduct, or disruptive behaviour;
-
share unlawful, defamatory, or inappropriate content;
-
impersonate another person or organisation;
-
interfere with the operation or security of the platform.
PIARC reserves the right to remove participants from sessions or suspend Accounts in the event of inappropriate conduct.
Due to the collaborative and interactive nature of the Programme, Participants acknowledge and agree that certain personal information may be visible to other registered Participants and facilitators during webinars, discussions, networking activities, and collaborative platform functions.
This may include:

first name and surname;
-
professional title;
-
organisation or employer name;
-
country or region;
-
profile image, where voluntarily uploaded.
By registering for the Programme, Participants expressly consent to this limited sharing of professional identity information for educational, networking, and programme participation purposes.
Participants should not disclose confidential, sensitive, or proprietary information during live discussions or collaborative activities.
All Content provided through the Platform is protected by intellectual property laws and remains the property of PIARC and/or its licensors unless otherwise stated.
Participants are granted a limited, non-exclusive, non-transferable licence to access and use the Content solely for personal professional learning purposes.
Unless expressly authorised in writing, Users may not:

reproduce, distribute, modify, publish, or commercially exploit Content;
-
record, rebroadcast, or redistribute webinars;
-
share access credentials or paid materials with third parties.
Live sessions may be recorded for educational, accessibility, quality assurance, and replay purposes.
By participating in live sessions, Participants acknowledge that:

their name, comments, questions, or contributions may appear in recordings;
-
recordings may be made available to registered participants;
-
recordings may be retained for programme administration and educational purposes.
Participants who do not wish to appear in recordings should avoid using video/audio participation features or identifiable profile images during sessions.
- Programme fees, including individual session pricing and full-series pricing, are published on the registration platform.

Preferential pricing may apply to eligible PIARC members.

All prices are displayed in Euros (€) unless otherwise specified and may be subject to applicable taxes.

Payment is required prior to access being granted unless otherwise agreed in writing.

PIARC reserves the right to modify pricing for future registrations at any time.
Where applicable under European consumer protection laws, eligible consumers may have a statutory 14-day withdrawal period beginning from confirmation of registration.
However, by accessing the online content or attending a session before the expiry of this period, Participants expressly request immediate performance of the Services and acknowledge that withdrawal rights may be reduced or lost once the Services have commenced.
Unless otherwise stated:
-
cancellations requested before the start of the first session may be eligible for a partial or full refund;
-
once a session has been attended or programme access has commenced, fees may become non-refundable;
-
substitute participants from the same organisation may be accepted subject to prior approval.
Refund requests must be submitted in writing.
Participants who complete the Programme requirements, including attendance and assessment criteria, may receive a PIARC-endorsed Certificate of Achievement.
Participants who attend sessions but do not complete the exam may receive a Certificate of Attendance.
PIARC reserves the right to verify eligibility before issuing certificates.
Use of the Platform is also governed by the Privacy Policy available at:
PIARC processes personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR) and applicable French data protection legislation.
Participants are responsible for ensuring they have:

a suitable internet connection;
-
compatible hardware and software;
-
access to webinar and learning technologies required for participation.
While PIARC aims to ensure continuous availability of the Platform, uninterrupted access cannot be guaranteed.
PIARC shall not be liable for interruptions caused by:
-
internet or telecommunications failures;
-
third-party platform outages;
-
force majeure events;
-
maintenance or security operations.
Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.
To the fullest extent permitted by law, PIARC shall not be liable for:

indirect or consequential losses;
-
loss of business, profit, or opportunity;
-
technical interruptions outside its reasonable control;
-
participant misuse of the Platform or Content.
PIARC’s total liability relating to the Services shall not exceed the amount paid by the Participant for the relevant Programme or session.
PIARC shall not be held liable for failure or delay in performance resulting from events beyond its reasonable control, including but not limited to:

natural disasters;
-
governmental restrictions;
-
labour disputes;
-
cyberattacks;
-
pandemics;
-
failures of telecommunications or hosting providers.
PIARC reserves the right to modify these Terms, the Programme structure, or the Platform where reasonably necessary.
Updated Terms will be published on the Platform and become effective upon publication.
Continued use of the Services after publication constitutes acceptance of the revised Terms.

17.1 We make no warranty or representation that the Website will meet your requirements, that it will be of satisfactory quality, that it will be fit for a particular purpose, that it will not infringe the rights of third parties, that it will be compatible with all systems, that it will be secure and that all information provided will be accurate. We make no guarantee of any specific results from the use of our Service or Services.

17.2 No part of this Website is intended to constitute advice and the Content of this Website should not be relied upon when making any decisions or taking any action of any kind.

17.3 No part of this Website is intended to constitute a contractual offer capable of acceptance.

17.4 Whilst We use reasonable endeavours to ensure that the Website is secure and free of errors, viruses and other malware, you are strongly advised to take responsibility for your own internet security, that of your personal details and your computers.
These Terms and any dispute arising from or relating to the Services shall be governed by and construed in accordance with the laws of France.
Any dispute relating to these Terms shall fall within the exclusive jurisdiction of the competent courts of Paris, France, unless mandatory consumer protection rules provide otherwise.

19.1 The Website is provided “as is” and on an “as available” basis. PIARC uses industry best practices to provide a high uptime, including a fault-tolerant architecture hosted in cloud servers. We give no warranty that the Website or Facilities will be free of defects and / or faults and we do not provide any kind of refund for outages. We provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality.

19.2 We accept no liability for any disruption or non-availability of the Website resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.
Under the conditions provided for by the applicable regulations, the User has a right of access, rectification and opposition, as well as the right to withdraw his/her consent at any time without prejudice to the lawfulness of the processing carried out before his/her withdrawal, a right of portability, erasure, limitation and the right to define guidelines relating to the conservation, erasure and communication of his PADs after his death.
